Terms and Conditions for Equipment Buyer
Please Read Carefully Before Bidding!
1. I am responsible for making settlement for any purchases made with this number before leaving the auction, unless I have notified the auction company that the number has been lost or stolen.
2. NO WARRANTY: ALL ITEMS ARE SOLD “AS IS” “WHERE IS” NO WARRANTY OR GUARANTEE OF ANY KIND. All items are sold “As is”, “Where is,” without guarantee of any kind. The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by the Auction Company (or their agents or officers) concerning any item shall be constructed as a warranty, either expressed or implied. I, the Bidder, have examined this merchandise and accept it the way it is. We have disclosed all that we are aware of about each item; however, it is the buyer’s responsibility to inspect the item prior to placing a bid. All sales are FINAL with no returns. Neither Auction Company nor seller make any guarantees whatsoever concerning the items to be sold. It is solely up to the bidder to inspect and examine the items to be sold, and to ask any questions if necessary. Buyer should be satisfied as to the condition of the items to be sold prior to, bidding.
3. I understand that Buyer’s Premiums of 10%, appropriate tax, and other fees are applied to the total price and I am responsible for these in addition to my bid price on any given item.
4. If I pay by check, I guarantee that I have funds on deposit to cover the amount of check, and I will not stop payment on such check. If my check is not honored by my bank, I agree to pay any fees, including attorney and filing fees, necessary to collect it, plus service fee imposed by auction company.
5. Do Not share bidder number, you are responsible for every item charged to your bidder number.
6. I acknowledge responsibility for any personal injury or property damage I or my agent, may cause to persons or property, and agree to hold auction company harmless for any personal injury to myself or my agents or property damage incurred on auction premises. Video and/or Audio-taping of auction site and proceedings may take place without further notification.
7. The Auction Company acts only as the Seller’s agent.
8. Inspections - Southern Auction Solutions recommends you to inspect the item prior to bidding. Descriptions believed to be correct but are not guaranteed to be so.
9. Bill of Sale- We will provide a Bill of Sale for items which require one.
10. The Issuing of Title- The title will be provided by the Seller within a reasonable time frame. If a problem with a title is found Seller will have a reasonable time to correct the issue.
11. Tax Exempt- Dealers that are tax exempt should provide proof of their exception to the auction company. We must have this documentation on file in the event of an audit. If you fail to present proof of your exception you will be required to pay sales tax.
12. Pick up- All items must be removed by Friday, April 21st @ 5:00 pm CST or the item becomes the property of the Auction Company.
13. Storage- Storage will be in the amount of $25.00 per day and will charged starting 6 days from the close of the auction. Southern Auction Solutions employees are not responsible for any damage to any item.
14. Shipping- Shipping will be the responsibility of the Buyer totally.
15. Abandonment- Any item not picked up by Friday, April 21, 2023 @ 5:00 pm CST becomes the property of the Auction Company with no refund to the Buyer.
16. Load Out- We will be available to assist in most cases with load out from Auction Day until Friday, April 21, 2023, after that date you will be charged storage and load out fee.
17. Removal- Once an item is announced SOLD it is yours and you are responsible to protect the item, even though you may not have paid for the item, yet. The item may not leave the premises without being paid for with the Auction Company Office. Merchandise charged to my number becomes my responsibility as soon as it is SOLD, along with all risk of loss or damage.
18. Dispute- The Auctioneers shall designate the winning bidder after each item is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to reopen the bidding. The Auctioneer’s designation of a Buyer shall be final.
